[ PRIVATIZATION ] It's not just about the money

As conversations crank up about the effects of private Corporate money on public elections now that the full effect of the Citizens United Supreme Court Decision is upon us, more Corporate money than ever before is being predicted to influence outcomes of elections not just in Presidential and Congressional elections of 2012, but all the way down to municipal and school board elections this Fall of 2011.
And while most efforts to modify this decision -- like with a Constitutional Amendment -- will take years to succeed, if ever, there's one key element that is being virtually ignored, perhaps because attention is willfully and forcefully being directed down diversionary pathways.
What does "privatization" of Government functions actually mean?
What is being ignored by focusing on "greedy" Wall Street wanting to turn every Government function, except the military, into a private enterprise, is this: All sorts of outlandish dangers from "America becoming a socialist nation!" are being shouted to create a manufactured climate of fear, frequently repeated by those who understand little about socialism, our history, or how Government works.
Take for instance the current recurring right-wing drive to privatize everything from Social Security and Medicaid to the Post Office. Republicans have for years been sabotaging public functions to make them fail, causing their argument this would not happen if operated under a profit motive. Every tea party/conservative effort in Congress is launched with the hope that our Government shall fail.
If this were coming from a foreign power, we'd instantly call it an all out Attack. But being launched by private Corporations, none dare call it treason.
For Example: The US Postal Service would be operating in surplus if not for a Bill rammed through a Republican Congress on a voice vote in December 2006, and signed by President Bush. This Bill required $5 billon annual PRE-payments toward retiree health benefits for 75 years into the future -- "something no other Government or private corporation is required to do," asserts Ralph Nader. http://act.rootsaction.org/p/dia/action/public/?action_KEY=4782
Profit motivation under private enterprise is touted as the "be all - end all" solution to bureaucratic "inefficiencies". Privatization fixes these very simply: by jacking up prices.
But that is only a minor part of the engine driving privatization, dominating the political spectrum for 30 years, since Reagan became President. The goal is not just short term profit taking. The goal is total wreckage of democracy in America.

What is the Constitution, and what does it NOT do under privatization?
In simplest terms, our Constitution is nothing more than a contract between our Government and its citizens. Because the Constitution as first presented appeared to dominate individuals in a way similar to the yoke of oppression that the Revolution was fought to remove, a Bill of Rights was added in order for it to pass approval of the original 13 Colonies, who were agreeing to operate by certain principals in the contract.
What the pushers of privatization never tell you is that our Constitution does NOT work inside any private Corporation. What? You mean 'freedom' and 'liberty' are not universal across all of America? Of course they are not, and you know it, if you just pay attention.
The Bill of Rights does NOT work inside any private Corporation. Take the simple example of privatizing the Post Office. Even tho the Post Office operates as an independent public entity, if you don't like what goes on, you have a place to complain and change things: Congress.
If the US Postal Service were privatized, like UPS or Federal Express, you cannot go to Congress to complain. More than that: while a Government agency, Congress can pass laws, rules, suggestions, whatever to affect running of the Post Office. Once privatized, that all ends.
Why? because the contract between the Government and its citizens has been broken.
The Constitution does not operate inside private Corporations, either for-profit, or non-profit.
If US Postal Service, or any Government agency, does something you think violates your rights protected under the Constitution, you can petition Congress, you can go to the courts, you can stand on Post Office property and hand out leaflets to everyone expressing your grievances. Your freedom to do so is guaranteed under the Constitution, your contract with your Government.
Can you do any of these things with UPS, Fed Express, or a privatized Post Office? Absolutely not.
You cannot find a competent lawyer anywhere in America who will sue a private Corporation for violating your Constitutional rights. Why? Because you have none. And if you stand on private Corporate property and hand out leaflets, you will be immediately arrested for trespassing on private property. Complain to Congress? Ha! That's private, not public.
The day before Post Office privatization, you can stand all day long on the steps and speak your piece to everyone who will listen. The next day, after privatization, you will be immediately arrested.
Democracy under the Constitution, and fascism under private Corporations is as different as night and day. And you know this, if you will only stop and think about it. You lose every freedom you have under the Constitution the instant a Government agency becomes private.
But stopping to think about it is exactly what the transparent swindlers of tea party conservative Republicans do NOT want you to do: everything they do is to obscure what you lose, buy making false claims about what you gain.
The very people who claim they protect your freedom, in actual fact want to steal it from you by the mechanism of privatization. Their highest goal is to take every Government function which is protected for you by your Constitution, and tuck it away in the one place where all your freedom is stripped away: inside a private Corporation.
Look at what's going on today on Wall Street, home of the driving force behind all privatization efforts. Americans are guaranteed under their Bill of Rights that they can peacefully assemble in public streets and parks. But if demonstrators step one foot inside any of the private Corporations just a few yards away, they go to jail for trespassing on private property. What is the difference? Your contract with your Government ends at the doorsill of every private Corporation in America.
Is this beginning to sink in? The driving force is not just money to increase private profits. The driving force is what it always has been for the Aristocracy of Wealth: to shrink your rights under the Constitution to the point that it becomes a meaningless piece of paper.
So, you can work for the next five years trying to Amend the Constitution to reverse the effect of the Citizens United case as a quantum leap of dominance by Corporate fascism, and all the while, if you let Government function slip away into privatization, it won't matter. Because NO Amendment to the Bill of Rights operates inside a private Corporation. They know this, and count on you not knowing this.
Democracy is Government by the People. Fascism is Government by Corporations.

What is a Corporation, anyway?
Corporations are legal fictions chartered to exist by one of 50 State Governments. Once, more than a century ago, charters were temporary, designed to expire after a task was accomplished, like building a bridge, or to be renewed after a period of time, say 20 years. At that point, the State decided if the Corporation was needed anymore, an if not, no charter renewal. States had control over private Corporations. There are no national private Corporations traded on Wall Street. All are State chartered.
The reason Corporations were temporary had to do with our ancestor's fear of unstoppable private power which would build inside a Corporation if the State did not maintain control. Earlier generations understood that that was why the Revolution was fought: as a release from oppression resulting from British Royal grants and charters to establish Colonies in America for the sole purpose of profit taking.
In the years after the Civil War, with growth of giant Corporations from massive wealth being generated by railroads, steam ships, steel, and oil during the Industrial Revolution, lawyers for these Corporations quietly went into every State Legislature and had these legal fictions made 'perpetual', meaning once chartered, the State could not end them. It was an enormous loss of States Rights to private enterprise, which few recognize. Making Corporations perpetual was a massive paradigm shift.
In our current times, why would a State issue a charter to a legal fiction, if State Government's role is to protect the best interests of its citizens? One reason might be for the Corporation to pay taxes to the State. Another might be for the Corporation to provide citizens with good jobs at fair pay. It's actually NOT in the State's best interests for a Corporation it charters to pay stockholders, if stockholders are out-of-State and pay the State no taxes on profits they take.
And then there's the problem of giving legal fictions 'personhood', causing a Pandora's Box to be opened, and the 2nd massive paradigm shift occurred. Actually, no law was passed, no ruling issued, no executive order signed to create this travesty affecting all of American life. It was an almost accidental inclusion of a phrase by a clerk in a case with the untended consequence of bestowing the rights of a living, breathing person upon a scrap of paper.
Of course, the Aristocracy of Wealth took this massive gift and ran with it, compounding error on top of error, ruling after ruling, to hide the fact that it has no real basis in law. Since I heard of this decades ago, I've never understood why some enterprising young lawyer did not build a name for her/himself by simply appealing to overturn this ersatz basis upon which our current legal monstrosity has been constructed.
Instead of ineffectively whining about symptoms, go for the cause of the disease.

So, here we are, well into the 2nd War for American Independence: Independence from Corporate domination for us and all future generations. The enemy are descendants of centuries of the Aristocracy of Wealth which our first War for Independence was fought over. This current unstated War is democracy vs. fascism.
Battles are being fought by patriots, who understand what is being lost, against dedicated wealthy and powerful Corporate fascists, while the majority of Americans have no idea a War is happening at all.
Some call this a Class War, which it is. It's a Class War declared by the 2% Aristocracy of Wealth against the 98% rest of us. But even that is being used as a slogan to keep from seeing the real goal.
Total diversionary fantasy frauds are being launched, like the bogus time-wasters of Congressional fights over the 'debt ceiling'. Anything that can increase the fog of War against our democracy shall be used by the enemy. The foundation truth is extraordinary simple, the one they do NOT want you to see:
If your public services -- from fire protection to Social Security Insurance to checking out a library book or mailing a letter -- can be slipped away from the freedoms guaranteed every citizen under our Constitution, and become services provided by private Corporations only to those who can pay their price for them, then democracy has been effectively sabotaged.
That is their goal. That is the primary goal.
If they win that, all else they desire falls into place.
